Definitions
Client or purchaser shall mean the individual or company to whom the offer is addressed. Delta Carpets Vinyls and Blinds refers to Delta Carpets Vinyls and Blinds Pty Ltd. Order shall refer to the online acceptance by the Purchaser.
Acceptance and Cancellation
If Delta Carpets Vinyls and Blinds agrees in writing to permit the Purchaser to postpone, cancel or reduce the order then the Purchaser will remain liable for all costs reasonably incurred by Delta Carpets Vinyls and Blinds in fulfilment of the order.
Price
GST (Goods and Services Tax) will be charged at a rate of 10%, unless legislation is changed by the Federal Government. Delta Carpets Vinyls and Blinds is bound by government legislation regarding rates of import duty and government taxes and reserves the right to pass on these costs to the Purchaser. All prices are correct at the time of publishing.
Terms of Payment
Delta Carpets Vinyls and Blinds’ online trading payment terms are strictly payment upfront before the goods can be allocated and released. Payment is accepted via our online gateway and can be made using Visa or Mastercard only.
Delivery
Dispatch of goods will occur within 48 hours of the online order being processed, subject to stock availability. Any delivery time is given in good faith and is intended as an estimate only based on the precision of our chosen courier company. Delta Carpets Vinyls and Blinds shall not be liable for any loss or damage whatsoever including but not limited to any consequential loss, loss of profits, damages or expenses sustained by the Purchaser as a result of a delay in the delivery of the goods or part thereof.
Ownership
Property of the goods delivered shall pass to the Purchaser once the goods and delivery charges have been paid for in full.
Insurance
The Purchaser’s risk of loss or damage to the goods passes to the Purchaser at the time that the goods are purchased. It is the Purchaser’s responsibility to ensure that goods are insured and covered for their time in transit.
Product Warranty
Delta Carpets Vinyls and Blinds warrants on behalf of the manufacturers that all products will be free from any defect in material. Delta Carpets Vinyls and Blinds will not be liable for any defect or damage caused to any product after delivery to the purchaser. This does not apply to goods purchased at a reduced price for being identified and sold as “seconds”.
Disputes
If the Purchaser claims that any goods are faulty or defective they must notify the reasons in writing within 21 days of the purchase date, failing which the Purchaser loses any right to dispute the quality of the goods.
Right to amend terms and conditions
Delta Carpets Vinyls and Blinds reserves the right to amend terms and conditions by way of displaying them under the terms and conditions page on this website.
Law of Contract
The Law of the State of Victoria shall apply unless specifically agreed otherwise.
